I'm Shari Khan, the South Asian attorney. I'm licensed to practice law in the U.S. and I help people worldwide with American immigration law. The first way is through the EB1A category, which is for people with extraordinary abilities in areas like science, arts, business, or sports. Now you don't need to have an Olympic medal or Nobel Prize. It would help though. You can still qualify for this category if you meet three out of the ten possible criteria. Here's what I mean. If you've won a recognized award in your field, if you're part of a group or organization that requires outstanding achievements, if you've been mentioned in major news or business magazines like the Forbes or Entrepreneur, if you've judged other people's work at events or conferences, if you've created something original or important in your field like writing a book or publishing research, there are other ways too such as having your work displayed at an exhibit, being a key leader in a company, or earning a higher salary compared to others in your field. You only need three out of these ten criteria and you'll be surprised how many people actually qualify. This option is especially popular because it doesn't require a job or sponsorship and it's available right now for many applicants. The second way to get a green card on your own is through the EB-2 National Interest Waiver. This is for people who are professionals or entrepreneurs working in fields that benefit the U.S. You need to have an advanced degree like a master's or PhD or at least a bachelor's with five years of experience. Here's how it works. If your work is in the national interest, meaning it's important for the U.S., you can apply for a green card without needing a job offer. This is great for professionals like doctors, architects, teachers, and even entrepreneurs. Architects, teachers, and even entrepreneurs. So if you want to qualify in this field, you're going to have to take three extra steps in addition to being a professional. So first, your work must benefit the U.S. as a whole. For example, you're a doctor and you're involved in some kind of research that is in U.S. national interest. Second, you must be able to prove that you have the skills, experience, or qualifications necessary to continue or advance your work. And finally, you have to show that it must be better for the U.S. to let you skip the usual job certification process. Why? Because your work is in the U.S. national interest. This is a very good option if you're a professional and can show the three criteria I mentioned above. So the third way to get a green card on your own is through the EB-5 investor visa. This is for people who already have the money to invest. There are two ways to do this. Invest in a regional center. This is a government-approved project. You can invest $900,000 into it. You'll get a green card for two years, and if everything goes well, after two years, you can apply to make your green card permanent. In addition, you can usually get your investment money back after about six years. The second way is to invest in your own business. If you want to invest $1.8 million into your own project and can create 10 jobs for U.S. workers, you can also get a green card this way. This option is really popular with people who already have the funds. All right, so to recap, here are the three ways you can get a green card on your own. First, EB-1A for people with extraordinary abilities in their field, like top professionals, artists, or athletes. Second, National Interest Waiver for professionals and entrepreneurs whose work is important to the U.S. And third, EB-5 investor visa for those who have money to invest in either a government-approved project or their own business.
