DHS's use-of-force policy says that an agent should avoid placing himself in front of a vehicle that could be a threat and advises against shooting at moving vehicles. Beyond questions about whether the shooting was within DHS or DOJ regulations, the question over whether the second and third shots could be justified legally may never be tested in a court of law. The Deputy Attorney General previously announced that the agent's actions were justified and will not be subject to criminal investigation.
