Speaker 1: The 4th potential way to challenge a DWI in New Jersey is to challenge the Alcatest machine itself. I am an Alcatest 7110 certified DWI defense lawyer. What does that mean? It means that I went to a seminar in 2010 with Draeger Safety. Draeger is the manufacturer of the Alcatest machine in New Jersey. The vice president of Draeger gave a seminar to about 20 attorneys in New Jersey and I was one of them. We learned about the machine, we learned about the components, and we are now certified and licensed to actually properly utilize the machine. I could be the person giving you the breath test result. I know how to do that. I use this specialization and expertise to attack the breath testing device in your particular case. The foundational documents for the Alcatest machine are extensive. They have to provide us with calibration records, solution change reports, any repair records. If the municipality had any problems with the machine and the machine has had to be sent back to the manufacturer for testing, then they have to provide us with those repair records. If they are not provided, this can be grounds to have your Alcatest reading suppressed. People aren't perfect and sometimes the machine is not utilized properly.
